Disclaimer / End User Licence Agreement:

1. Introduction:

By downloading, installing, or using this Minecraft plugin (further referred to as "Plugin"), you, the end user (further referred to as "User"), agree to be bound by the terms set forth in this Disclaimer / End User Licence Agreement (EULA). If you do not agree, do not download, install, or use the Plugin.

2. Data Collection and Privacy:

2.1. Data Handling & Purpose:

This Plugin uses bStats to collect and analyze certain statistical data about your Minecraft server, including but not limited to:

• Server version and Plugin version
  
• Player count (numerical only)
  
• System specifications (operating system, Java version, etc.)
  
• Other anonymized metrics necessary for usage statistics.

2.2. Data Handling & Legal Basis:

The collected data is used strictly for statistical and analytical purposes. bStats may store certain technical information (such as your server's IP address) temporarily for processing and/or security reasons. For details, please refer to bStats Privacy Policy.

2.3 Personal Data

If personal data is processed, the following legal bases apply:

Art. 6(1)(a) GDPR: Consent is provided by installing and using the plugin.
Art. 6(1)(a) GDPR: The legitimate interest of improving the Plugin and ensuring compatibility and functionality.

2.4. Your Rights

You have the right to request access, rectification, deletion, or limitation of processing of any personal data that might be collected via bStats. For exercising those rights, please consult bStats own procedures.

3. Grant of License & Usage Rights

3.1. License Grant

You are granted a non-exclusive, non-transferable right to install and use this Plugin solely on your own Minecraft server(s).

3.2. Prohibited Actions

Decompiling or Reverse Engineering: You shall not decompile, reverse engineer, disassemble, or otherwise derive source code from the Plugin, except to the extend expressly permitted by applicable law.
Redistribution: You shall not distribute, sublicense, sell, rent, lease, or otherwise transfer the Plugin or any modifications thereof to third parties.
Creation of Derivative Works: You shall not modify or create derivative works of the Plugin or any part of it without explicit written permission from the Plugin's developer.
Misrepresentation: You shall not claim authorship of the Plugin or any portion of it.

4. Liability & Warranty

4.1. Provided "As is"

The Plugin is provided on an "as is" and "as available" basis. No warranties of any kind, whether express or implied, are given. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

4.2. Limitation of Liability

To the maximum extent permitted by German law, the Plugin's developer (hereafter "Developer") shall only be liable for damages caused by intentional or grossly negligent conduct. Liability for slight negligence is excluded, except in casses of injury to life, body, or health.

In no event shall the Developer be liable for any indirect, consequential, special, or incidental damages (including, but not limited to, data loss, server outages or disruptions, or other economic losses) arising out of the use or inability to use the Plugin.

4.3. No Liability for External Services

The Developer is not liable for services provided by external services (such as bStats) or thrid-party software used in conjunction with the Plugin.

5. Governing Law

This Disclaimer/EULA and any dispute arising out of or relating to it shall be governed exclusively by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

6. Place of Jurisdiction

6.1. Exclusive Jurisdiction (Business Users)

If you are a merchant ("Kaufmann"), a legal entity under public law, or a special fund under public law within the meaning of §§ 1 ff. Handelsgesetzbuch (German Commercial Code), or if you have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from or related to this Disclaimer / EULA shall be the Amtsgericht Augsburg (District Court of Augsburg), Germany.

6.2. Jurisdiction for Consumers

If you are a consumer ("Verbraucher") within the meaning of §§ 13 Bürgerliches Gesetzbuch (BGB), any mandatory statutory provisions regarding venues and jurisdictions shall remain unaffected. However, if no such mandatory provisions apply, the courts of Augsburg, Germany, shall have non-exclusive jurisdiction.

7. Final Provisions

7.1. Severability Clause

Should any provision of this Disclaimer / EULA be or become invalid or unenforceable, the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be deemed replaced by a valid, enforceable provision that most closely reflects the intent of the original provision.

7.2. Changes & Updates

The Developer may, reserves the right to modify or revise the terms of this Disclaimer / EULA for valid reasons, such ass changes in law, security updates, or improvements to existing features. In the event of material changes, the Developer will provide reasonable notice to users - e.g., via the official plugin page, a notification in the support Discord, or as part of an update changelog. Continued use of the Plugin after the effective date of any such changes constitutes acceptance of the revised terms. If you do not agree to the updated terms, you may uninstall and discontinue using the Plugin.
